TERMS OF PURCHASE
GrubCanada Inc. assumes all responsibility for the service of sending the restaurant the order. Once the restaurant has received the order, GrubCanada Inc. does not assume any responsibility or liability for the actions, products, and content of the restaurant related to the creation or delivery of your order. You agree to pay all fees and charges incurred in connection with your purchases (including any applicable taxes) at the rates in effect when the charges were incurred. We may require additional verifications or information before accepting any order.
METHODS OF PAYMENT:
CASHBy selecting CASH as a method of payment, you agree to provide the restaurant payment in the form of CAD ($) upon receipt of your order.
CREDIT CARDBy selecting CREDIT CARD as a method of payment, you agree that you must be authorized to use the credit card presented as a method of payment. Prior to the purchase of any goods or services on our website, you must provide us with a valid credit card number and associated payment information including all of the following: (i) your name as it appears on the card, (ii) your credit card number, (iii) the credit card type, (iv) the date of expiration and (v) any activation numbers or codes needed to charge your card. If GrubCanada Inc. does not receive payment from your credit card issuer or its agent, you agree to pay all amounts due upon demand by GrubCanada Inc. or its agents. The final charges on your credit card may be different than those stated on the website.
CAMPUS CARDSBy selecting CAMPUS CARD as a method of payment, you agree that you must be authorized to use the campus card presented as a method of payment. You agree to submit any card number or activation numbers or codes needed to debit your account. You also agree to honor the terms & agreement of purchase as presented by your card issuer.
GRUBCANADA DOLLARSBy selecting GrubCanada Dollars as a method of payment you agree that you are the authorized user of the account and, as such, authorize GrubCanada Inc. to deduct and remit the stated amount from your account to the restaurant partner fulfilling your order. GrubCanada Dollars is not a credit program. If the total amount of the purchase is greater than your available GrubCanada Dollars, your credit card will be charged for the outstanding balance.
PURCHASING GRUBCANADA DOLLARS OR RESTAURANT DOLLARS
GrubCanada Dollars allows you to load a dollar value into your GrubCanada.com Account in the form of GrubCanada Dollars or Restaurant for future online purchases at participating restaurants with GrubCanada Inc. Unless otherwise required by law or permitted by this agreement, any amount in your GrubCanada Account, whether in the form of GrubCanada Dollars or Restaurant Dollars, is non-refundable and may not be redeemed for cash. In instances where refunds are required, they may be subject to penalties and fees. An inactivity fee of $4 per month will be administered for any account with a balance that has remained inactive for a period of one year. No interest, dividends, or any other earnings on funds deposited into your GrubCanada Account as GrubCanada Dollars or Restaurant Dollars will accrue or be paid or credited to you by GrubCanada Inc. GrubCanada Dollars or Restaurant Dollars is not transferable from person to person nor from restaurant to restaurant (unless required due to restaurant no longer participating in the program). GrubCanada Inc. reserves the right not to accept any GrubCanada Dollars or Restaurant Dollars, or otherwise limit use of GrubCanada Dollars or Restaurant Dollars, if it is reasonably believed that the use is unauthorized, fraudulent or otherwise unlawful. You are responsible for all transactions associated with the GrubCanada Dollars or Restaurant Dollars in your GrubCanada Account, including unauthorized transactions. Purchase of GrubCanada Dollars or Restaurant Dollars constitutes acceptance of these terms & conditions.
RETURN POLICY
If you are not satisfied with your order, please contact GrubCanada Inc. Customer Service immediately via email at support@grubcanada.com and include the order number and restaurant name. All sales are final unless order problems/issues are confirmed with our restaurant partners or otherwise determined by GrubCanada Inc. at its sole discretion, to be actionable. In such cases, GrubCanada Inc. will issue credit for use on future orders through the GrubCanada Inc. website. All order problem/issue inquiries must be received within 24 hours of the order date listed on your order confirmation email. No cash refunds will be issued by Grubcanada Inc.
CHILDREN
You may not use the GrubCanada.com Web site if you are under thirteen (13) years of age. Likewise, GrubCanada Inc. will not store or record information from any person under the age of thirteen (13).
By registering or placing an order with us, you are consenting to receive e-mails from us regarding your registration or your order. Additionally, by registering or placing an order with us, you are consenting to receive commercial e-mail from us. If you do not wish to receive commercial email from us, you may remove your name from the e-mail list and edit your personal information from the GrubCanada Inc. computer system by updating your account information.
REVIEWS AND COMMENTS
If at any time, GrubCanada Inc. enables site visitors to post reviews of and comments on products featured on the site, the party posting that comment or review grants GrubCanada Inc. and its affiliates a non-exclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such reviews and comments throughout the world in any media. You also grant GrubCanada Inc. and its affiliates the right to use the name that you submit with any review or comment, if any, in connection with such review or comment.
RISK OF LOSS
All items purchased through GrubCanada.com are made pursuant to a delivery contract. Should there be delivery errors; GrubCanada Inc. will offer reasonable assistance in the correction of that error. However, the risk of loss and title for such items pass to you upon our delivery to the carrier. You must file any such claims with that delivery carrier.
INDEMNITY
You agree to indemnify and hold GrubCanada Inc., its subsidiaries, affiliates, officers, agents, and other partners and employees harmless from any loss, liability, damage, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of this Web site, including your use of this Web site to provide a link to another Web site or to upload content or other information to the Web site.
